Terms and conditions

These terms apply when you use verifycar.com.au or order a vehicle history report from us. By ordering a report you accept them. Please read them alongside our Privacy policy.

1. Who you are dealing with

VerifyCar is operated by [[ LEGAL ENTITY NAME ]] (ABN [[ ABN ]]), referred to in these terms as “we”, “us” and “our”. You can reach us at info@verifycar.com.au.

2. What we provide

When you submit a Vehicle Identification Number (VIN) and pay, we run a search of the Personal Property Securities Register (PPSR) and the National Exchange of Vehicle and Driver Information System (NEVDIS) for that VIN, and send you a report by email. The report includes:

• whether the vehicle is recorded as a repairable or statutory write-off;
• whether the vehicle or its plates are recorded as stolen;
• registered security interests against the vehicle (money owing);
• vehicle description details held by NEVDIS; and
• the official PPSR certificate for the search, as a PDF.

The report is also available at a link we email you, which stays active for 30 days from the date of the search. The certificate PDF is attached to that email so you can keep it after the link expires.

3. What we do not provide

So there is no doubt about the scope of what you are buying, the report does not include:

• a physical inspection. We do not see, drive or assess the vehicle. The report describes records, not condition;
• odometer history. This is not part of the report at this time;
• a search by registration number. Searches are by VIN only;
• the identity of the registered owner. This is not available in a consumer report; and
• a market valuation, or legal or financial advice. The report is information to help you decide. It is not advice and should not be relied on as advice.

4. Your responsibilities

We search the VIN you give us. If the VIN is wrong, mistyped, or belongs to a different vehicle, the report will be about that other vehicle and will not tell you anything useful about the car you are looking at. Please check the VIN against the car itself before you order, and give us an email address you can actually receive mail at.

Reports are supplied for your own use in connection with a vehicle you are considering. You may share a report with your mechanic, your insurer or your adviser. You may not resell it, republish it, or use our service to build or supply a competing data product.

5. Price and payment

A report costs $9.95 per vehicle [[ CONFIRM: GST inclusive? ]]. It is a single payment. There is no subscription, no account and no stored card.

Card payments are processed by Stripe. We do not receive or store your card number. Prices may change, but the price shown when you order is the price you pay.

6. Refunds

If a search cannot be completed — for example the registers do not return a result for the VIN, or a register is unavailable — you are refunded in full, automatically, to the card you paid with. You do not need to ask.

Because the report is generated and delivered immediately, we do not otherwise offer refunds for change of mind, or because a completed report did not contain the finding you hoped for. A report that correctly shows a vehicle is clear has done its job.

Nothing in this clause limits your rights under the Australian Consumer Law. If something has gone wrong with a report, email us and we will look at it.

7. About the information in the report

The information comes from the PPSR, which is administered by the Australian Financial Security Authority, and from NEVDIS. We do not create it, hold it or control it, and we cannot correct it. If you believe a record about a vehicle is wrong, that is a matter for the register concerned.

A report describes the registers as at the moment of the search. A security interest, write-off or theft record can be registered after your search has run. A report is not a guarantee about the future, and a search run today does not cover what happens tomorrow.

8. Availability

We aim to keep the service available at all times, but we depend on external registers and on our own hosting. We do not guarantee uninterrupted access, and we may suspend the service for maintenance.

9. Intellectual property

The design, text and layout of this website and of our reports belong to us or to our licensors. The underlying register data belongs to the bodies that maintain it, and our use of it is subject to their terms [[ CONFIRM: reflect the AFSA reseller agreement here ]].

10. Our liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees.

To the extent the law allows, our liability for any claim connected with a report or with this website is limited, at our option, to resupplying the report or refunding what you paid for it. We are not liable for a decision you make about buying, selling or keeping a vehicle. That decision is yours.

11. Privacy

Our Privacy policy explains what we collect when you order a report or contact us, who we share it with, and how to reach us about it.

12. Changes to these terms

We may update these terms. The version published here when you order is the version that applies to that order, and the effective date at the top tells you when it last changed.

13. Governing law

These terms are governed by the laws of [[ STATE OR TERRITORY ]], Australia, and you and we submit to the courts of that place.
